Gardeners Waterloo Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Waterloo provides gardening and related services to residential and commercial clients. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking or allowing our gardeners access to your property.

1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

Client means the person or organisation requesting or receiving services from Gardeners Waterloo.

Services means gardening, garden maintenance, garden clearance, lawn care, hedge trimming, planting, and any other services agreed in writing between Gardeners Waterloo and the Client.

Service Visit means a specific appointment or series of appointments during which the Services are carried out at the Client property.

Agreement means the contract between Gardeners Waterloo and the Client, which incorporates these Terms and Conditions together with any written quotation, confirmation, or scope of works.

2. Scope of Services

2.1 Gardeners Waterloo provides general gardening and maintenance services, including but not limited to grass cutting, hedge trimming, pruning, weeding, planting, garden tidy-ups, seasonal maintenance, and related outdoor works as agreed.

2.2 Any description or example of Services on our website, advertising material, or verbal discussions is illustrative and not exhaustive. The exact scope of work for each Service Visit will be agreed in advance with the Client, either verbally or in writing.

2.3 We reserve the right to refuse any work that we consider unsafe, unlawful, unsuitable for our expertise, or beyond the agreed scope, including work at height or work requiring specialist qualifications or equipment we do not hold.

3. Booking Process

3.1 Bookings for Services can be made by the Client by contacting Gardeners Waterloo and providing the required information, including property location, type of work required, and preferred dates.

3.2 All bookings are subject to availability and are not confirmed until Gardeners Waterloo has issued a booking confirmation, which may be provided verbally or in writing.

3.3 At the time of booking, we may provide an estimate or quotation based on the information supplied by the Client. Where a site visit is required to confirm the scope of works, any quotation provided prior to the visit is indicative only and subject to change.

3.4 The Client is responsible for ensuring that all information provided in relation to the booking is accurate and complete. Inaccurate information may result in changes to the time required, the price, or our ability to complete the Services.

4. Estimates and Quotations

4.1 Any price estimate given prior to a site visit is a guide only and not binding. A formal quotation may be provided once we have assessed the garden and the work required.

4.2 Quotations are valid for a limited period, which will be stated at the time the quotation is provided. If no period is stated, the quotation will be valid for 30 days from the date of issue.

4.3 Where Services are charged on an hourly or daily rate, the final charge will reflect the actual time spent on site, subject to any minimum call-out or minimum charge conditions advised to the Client.

5. Access and Client Responsibilities

5.1 The Client must ensure that Gardeners Waterloo has safe and unrestricted access to the garden and any relevant outdoor areas at the agreed time. This includes access to gates, paths, and any areas where Services are to be provided.

5.2 If access is not available or is delayed due to the Client or third parties, we reserve the right to charge for waiting time or to treat the visit as a late cancellation, in which case cancellation fees may apply.

5.3 The Client must inform us of any known hazards or risks at the property, including uneven ground, fragile surfaces, ponds, underground services, or any other potential dangers.

5.4 The Client is responsible for securing pets and ensuring that children and visitors remain at a safe distance from the work area while Services are being carried out.

6. Equipment, Materials, and Standards

6.1 Our gardeners will provide their own tools and standard equipment necessary to carry out the Services, unless otherwise agreed with the Client.

6.2 Where materials such as plants, turf, aggregates, compost, or decorative items are required, these may be supplied by Gardeners Waterloo at an agreed cost or provided by the Client, subject to prior agreement.

6.3 All Services will be carried out with reasonable care and skill, consistent with normal industry practice for general gardening and maintenance services in the United Kingdom.

7. Payments and Invoicing

7.1 The Client agrees to pay Gardeners Waterloo the charges for the Services as set out in the quotation, estimate, or agreed rate. Prices may be based on a fixed fee, hourly rate, or daily rate.

7.2 Payment terms will be communicated at the time of booking or as part of the quotation. Unless otherwise agreed, payment is due on completion of the Service Visit or within the period stated on the invoice.

7.3 We reserve the right to request a deposit or part payment prior to commencing work, particularly for larger jobs or where materials must be purchased in advance.

7.4 If the Client fails to make any payment on the due date, Gardeners Waterloo may charge interest on the overdue amount at the statutory rate permitted under UK law and may suspend or cancel further Services until full payment is received.

7.5 All charges are stated exclusive of any applicable taxes unless otherwise specified. Where applicable, the relevant taxes will be added to the invoice in accordance with UK regulations.

8. Cancellations, Rescheduling, and No-Show

8.1 The Client may cancel or reschedule a Service Visit by giving reasonable notice. The minimum notice period for cancellation or rescheduling will be communicated at the time of booking. If no specific period is mentioned, a minimum of 24 hours notice is required.

8.2 If the Client cancels or reschedules with less than the required notice, Gardeners Waterloo reserves the right to charge a cancellation fee, which may be up to the full amount of the scheduled visit, to reflect the time and costs incurred.

8.3 If the Client fails to provide access to the property at the agreed time, or if the gardener is unable to carry out the Services due to factors within the Client control, this may be treated as a late cancellation and cancellation charges may apply.

8.4 Gardeners Waterloo reserves the right to cancel or reschedule a Service Visit due to adverse weather conditions, staff illness, vehicle breakdown, safety concerns, or other factors beyond our reasonable control. In such cases, we will offer an alternative date or time. We will not be liable for any loss or inconvenience arising from such cancellations or rescheduling.

9. Garden Waste and Environmental Regulations

9.1 Gardeners Waterloo complies with applicable UK regulations in relation to the handling, transport, and disposal of green waste and other materials arising from our Services.

9.2 Unless explicitly included in the quotation or agreement, the removal and disposal of garden waste, soil, turf, branches, and other materials is not included in the standard Service and may be subject to additional charges.

9.3 If the Client wishes us to remove garden waste, this must be agreed in advance. Additional fees will reflect the volume, type of waste, and any applicable disposal or transfer costs.

9.4 Where waste removal is not included, garden waste may be left in a designated area on the Client property, as agreed with the Client, for their own disposal or composting, subject to local regulations.

9.5 We will not dispose of hazardous waste, contaminated materials, or items that fall outside normal garden waste categories. The Client is responsible for arranging appropriate disposal of such items through authorised channels.

10. Health, Safety, and Weather Conditions

10.1 Gardeners Waterloo is committed to operating in a safe manner and in accordance with relevant health and safety requirements in the United Kingdom.

10.2 We may suspend or modify the Services if weather conditions make it unsafe or unsuitable to continue, for example in the case of heavy rain, extreme heat, high winds, or other adverse conditions that could compromise safety or the quality of the work.

10.3 The Client agrees not to require or encourage our gardeners to carry out any activity that is unsafe, contrary to these Terms and Conditions, or in breach of any law or regulation.

11. Liability and Limitations

11.1 Gardeners Waterloo will exercise reasonable care and skill in providing the Services. If we are found to be at fault, our liability is limited as set out in this section.

11.2 We will not be liable for any pre-existing damage or defects to the Client property, plants, structures, or fixtures that are not caused by our negligence.

11.3 The Client is responsible for identifying and clearly marking any hidden features, such as underground cables, pipes, irrigation systems, or other concealed services. Gardeners Waterloo will not be liable for damage to such items that were not reasonably apparent and were not disclosed by the Client.

11.4 We will not be liable for indirect, consequential, or economic losses, including loss of profit, loss of enjoyment, or loss of opportunity, arising out of or in connection with the Services.

11.5 Our total liability to the Client for any claim arising out of the Services, whether in contract, tort, or otherwise, shall be limited to the total fees paid by the Client for the specific Service Visit or project during which the event giving rise to the claim occurred.

11.6 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to exclude or limit liability under applicable UK law.

12. Property, Plants, and Guarantees

12.1 While we take care to protect existing plants, lawns, and garden features, some disturbance or damage may occur as a natural consequence of gardening and maintenance work. The Client acknowledges that such minor disturbance does not constitute negligence or a breach of contract.

12.2 Where we supply plants, turf, or living materials, their ongoing health will depend on weather, soil conditions, pests, and the Client aftercare. We do not guarantee the long-term survival of plants or turf once supplied and installed, unless a specific written guarantee is provided.

12.3 Any guidance or recommendations we provide about garden care, watering, feeding, or maintenance is given in good faith but does not constitute a guarantee of results, as outcomes depend on many factors outside our control.

13. Complaints and Dispute Resolution

13.1 If the Client is dissatisfied with any aspect of the Services, they should contact Gardeners Waterloo as soon as reasonably possible so that we have the opportunity to investigate and, where appropriate, put matters right.

13.2 We may request details and, if relevant, photographs of the issue. The Client should not engage third parties to remedy the perceived problem before we have had a reasonable opportunity to review and respond, as this may limit our ability to offer a remedy.

13.3 We will aim to address complaints promptly and fairly. If a resolution cannot be reached informally, the dispute may be referred to an appropriate mediation or advisory service, if both parties agree.

14. Force Majeure

14.1 Gardeners Waterloo will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to extreme weather, natural disasters, acts of government, labour disputes, power failures, or transport disruptions.

14.2 In such circumstances, we may suspend the Services for the duration of the event or, where necessary, cancel the Agreement, in which case any advance payments for Services not provided will be refunded, subject to any reasonable costs already incurred.

15. Data Protection and Privacy

15.1 Gardeners Waterloo will handle any personal information provided by the Client in accordance with applicable data protection laws in the United Kingdom.

15.2 We will use Client details only for the purposes of managing bookings, providing Services, invoicing, and communicating in relation to our services, unless the Client consents to other uses or we are required to disclose information by law.

16. Changes to Terms and Conditions

16.1 Gardeners Waterloo may update these Terms and Conditions from time to time to reflect changes in law, industry practice, or our business operations.

16.2 The version of the Terms and Conditions that applies to a particular booking will be the version in force at the time the booking is confirmed. Any material changes will be made available to Clients upon request or via our usual communication channels.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Gardeners Waterloo.

By booking or using the Services of Gardeners Waterloo, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
